Website Terms of Use
Last updated: 21 October 2026
1. About these Terms
1.1 These Website Terms of Use ("Terms") govern your access to and use of the Site (defined in section 2). The Site is operated by Astral Media Group Limited, trading as Plutus Media ("Plutus", "we", "us", "our"), a company registered in England and Wales under company number 16085756, whose registered office is at Fitzrovia House, 3–5 Gower Street, London WC1E 6HA. Our VAT number is 514179791.
1.2 By accessing or using the Site, you agree to these Terms. If you do not agree, you must not use the Site.
1.3 These Terms apply to everyone who visits the Site, including prospective clients, existing clients, people reading our content, and anyone who submits information through the Site, for example by booking a call or downloading a guide.
2. Scope
2.1 "Site" means the website at https://www.byplutus.com and any of its subdomains, together with the content and features made available through it.
2.2 The Site does not include: (a) the performance dashboard at https://plutus.marketing; or (b) the creator platform at https://plutuscreators.com. Each of these is governed by its own separate terms of use and privacy policy, and nothing in these Terms applies to your use of them.
3. Eligibility and Business Use
3.1 You must be at least 18 years old to use the Site.
3.2 The Site is intended for use by individuals acting in a business or professional capacity, and not for personal, household or consumer purposes. By using the Site, you confirm that you are acting in that capacity and, where you act on behalf of an organisation, that you have authority to bind that organisation to these Terms.
4. Relationship to Client Agreements
4.1 Where we provide services under a signed Statement of Work, Master Services Agreement, insertion order or other written agreement (a "Client Agreement"), the Client Agreement alone governs those services, including scope, fees, deliverables and intellectual property in campaign outputs.
4.2 These Terms govern use of the Site only. They do not vary, supplement or replace any Client Agreement. If there is any conflict between these Terms and a Client Agreement, the Client Agreement prevails.
4.3 The exclusions and limitations of liability in these Terms apply only to your use of the Site and its content. They do not apply to, vary or limit any liability arising under a Client Agreement, which is governed exclusively by the terms of that Client Agreement.
5. Acceptable Use
5.1 You must not use the Site to:
(a) break any applicable law or regulation, or infringe anyone's intellectual property, privacy or other rights;
(b) upload, transmit or distribute any virus, malware or other harmful code;
(c) scrape, harvest or collect data from the Site using bots, scripts or other automated means, except as a result of standard search engine indexing;
(d) reverse engineer, decompile or attempt to extract the source code of any part of the Site;
(e) copy Content to build a competing product or service, or to reuse it for your own commercial purposes;
(f) impersonate Plutus, any of our staff, or any other person or organisation;
(g) send spam, unsolicited advertising or promotional material through any contact or booking tool on the Site;
(h) submit false or misleading information when making an enquiry or booking a call; or
(i) interfere with or disrupt the Site, or attempt to gain unauthorised access to any part of it or to any system or network connected to it.
5.2 We may suspend or restrict your access to the Site, without notice, if you breach this section.
6. Intellectual Property
6.1 All content on the Site, including text, graphics, case studies, guides and other material ("Content"), and the Plutus Media name, logos and branding (the "Marks"), are owned by us or our licensors and are protected by copyright, trade mark and other intellectual property laws.
6.2 We grant you a limited, non-exclusive, revocable, non-transferable licence to view and use Content for your own informational or internal business purposes, including evaluating our services. You may share links to Content. You may not otherwise reproduce, republish, distribute, sell or create derivative works from Content without our prior written consent.
6.3 Nothing in these Terms gives you any right to use the Marks. You may not use them without our prior written consent.
6.4 Feedback. If you send us feedback or suggestions about the Site, you grant us a perpetual, royalty-free licence to use them for any purpose without compensation to you.
6.5 Enquiries. Section 6.4 does not apply to information about your business, brand or campaign needs that you share when enquiring about, or booking a call regarding, our services. We claim no rights in that information, and we will use it only to respond to your enquiry and in accordance with our Privacy Policy.
7. Enquiries, Call Bookings and Guides
7.1 Call bookings on the Site are handled through a third-party scheduling tool (see section 10). Booking a call or making an enquiry does not oblige either you or us to enter into a Client Agreement.
7.2 Some Content, such as downloadable guides, may require you to submit your details to access it. We will tell you at the point of collection how we will use those details, including whether we will send you marketing communications. Our Privacy Policy explains this in full. You can unsubscribe from marketing at any time using the link in any email we send, or by contacting us.
7.3 We may change, delay or withdraw access to guides and other resources at any time.
8. No Professional Advice
8.1 Content on the Site, including articles, guides, case studies and other resources, is provided for general informational purposes only. It does not constitute professional, marketing, legal, financial or business advice tailored to your circumstances, and your use of it does not create an advisor-client or similar relationship.
8.2 You should seek independent professional advice before making any decision based on Content. To the maximum extent permitted by law, we disclaim all liability for any loss or damage arising from reliance on Content.
9. Results and Case Studies
9.1 Case studies, testimonials, metrics and examples of past campaign performance published on the Site ("Performance Examples") reflect results achieved for specific past clients under specific circumstances. Some figures may be rounded, aggregated, anonymised or presented as approximate ranges.
9.2 Performance Examples are provided for illustrative purposes only. They are not a prediction, projection, guarantee or warranty of the results any other client or campaign will achieve. Campaign performance depends on factors outside our control, including platform algorithm changes, creator performance, budget, market conditions, product-market fit and third-party platform policies.
9.3 We make no representation or warranty, express or implied, that any future campaign will achieve results comparable to any Performance Example. To the maximum extent permitted by law, we disclaim all liability arising from reliance on Performance Examples.
10. Third-Party Services
10.1 The Site may link to or embed third-party websites, tools or services, including social media platforms and our call-booking tool ("Third-Party Services"). We do not operate or control Third-Party Services and are not responsible for their content, availability, functionality or practices.
10.2 Your use of any Third-Party Service is governed by that service's own terms and privacy policy, not these Terms. A link to a Third-Party Service does not mean we endorse it.
11. Privacy and Cookies
11.1 Our Privacy Policy explains how we collect and use personal data, and our Cookie Policy explains how we use cookies and similar technologies.
11.2 The Site is hosted by third-party providers that may store or process personal data outside the United Kingdom, including in the United States. Where this happens, we rely on the safeguards required by UK data protection law.
12. Availability and Changes to the Site
12.1 We may change, suspend or withdraw the Site or any Content at any time, without notice. We do not guarantee that the Site will always be available or uninterrupted.
12.2 We aim to keep Content accurate, but we do not guarantee that it is complete, accurate or up to date. We may correct errors or omissions at any time.
13. Disclaimer of Warranties
13.1 The Site and all Content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, conditions and other terms, whether express or implied by statute, common law or otherwise, including any implied terms as to satisfactory quality, fitness for a particular purpose, accuracy or non-infringement.
13.2 We do not warrant that the Site will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Site is free of viruses or other harmful components. You are responsible for using your own virus protection software.
13.3 Nothing in this section excludes or limits any warranty, term or right that cannot lawfully be excluded or limited.
14. Limitation of Liability
14.1 Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.
14.2 Subject to section 14.1, we will not be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any indirect or consequential loss, or for any loss of profit, revenue, business, goodwill or data, arising out of or in connection with your use of, or inability to use, the Site or any Content.
14.3 Subject to section 14.1, our total liability to you arising out of or in connection with your use of the Site and Content shall not exceed £100 in aggregate.
14.4 This section applies only to your use of the Site and Content. Liability arising under a Client Agreement is governed exclusively by that Client Agreement (see section 4).
15. Suspension of Access
15.1 We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms.
15.2 Sections 4 (Relationship to Client Agreements), 6 (Intellectual Property), 8 (No Professional Advice), 9 (Results and Case Studies), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 17 (Governing Law and Jurisdiction) and 18 (General) continue to apply after your access ends.
16. Changes to These Terms
16.1 We may revise these Terms at any time by updating this page. We will update the "Last updated" date at the top and, where a change is material, we may also give notice on the Site.
16.2 Your continued use of the Site after a revised version is published means you accept it. If you do not agree to the revised Terms, you must stop using the Site.
17. Governing Law and Jurisdiction
17.1 These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), are governed by the laws of England and Wales.
17.2 The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.
18. General
18.1 Entire agreement. These Terms are the entire agreement between you and us about your use of the Site and replace any earlier agreement about it. This does not affect any Client Agreement, which is a separate agreement governed by its own terms.
18.2 Severability. If any provision of these Terms is found invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force.
18.3 No waiver. If we do not enforce any provision of these Terms, or delay doing so, that is not a waiver of our right to enforce it later.
18.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer ours, including as part of a merger, acquisition or sale of assets.
18.5 Third-party rights. No one other than you and us has any right to enforce these Terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
18.6 Events outside our control. We are not liable for any delay or failure to perform caused by events outside our reasonable control.
18.7 No partnership. Nothing in these Terms creates any partnership, joint venture, agency or employment relationship between you and us.
